1. Agreement to Terms

By accessing or using the ArcaSave platform, website, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

These Terms constitute a legally binding agreement between you and ArcaSave. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Services following any modifications indicates your acceptance of the updated Terms.

To use ArcaSave Services, you must:

  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account

ArcaSave reserves the right to suspend or terminate accounts that violate these Terms or engage in suspicious or fraudulent activity.

4. Services Description

ArcaSave provides digital dollar account services that allow users to hold, transfer, and earn yield on stablecoin deposits. Our Services include:

  • Digital dollar account creation and management
  • Deposit and withdrawal of supported stablecoins
  • Yield generation on deposited assets
  • Transaction history and account reporting

Important: ArcaSave is not a bank. Your funds are not FDIC insured. Digital assets involve risk, and past performance does not guarantee future results. APY rates are variable and subject to change without notice.

5. Fees and Charges

ArcaSave strives to maintain transparent and competitive pricing. Current fee schedules are available on our platform. We reserve the right to modify our fee structure with reasonable notice to users. Network fees for blockchain transactions are passed through at cost and are not controlled by ArcaSave.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable laws, regulations, or third-party rights
  • Using the Services for money laundering, terrorist financing, or other illegal purposes
  • Attempting to circumvent security measures or access unauthorized areas
  • Interfering with or disrupting the integrity of our Services
  • Engaging in market manipulation or fraudulent trading activities
  • Creating multiple accounts or misrepresenting your identity
  • Using automated systems to access the Services without permission

7. Intellectual Property

All content, features, and functionality of the ArcaSave platform, including but not limited to text, graphics, logos, icons, images, software, and the overall design, are the exclusive property of ArcaSave and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written consent.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ARCASAVE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCASAVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.

10. Indemnification

You agree to indemnify, defend, and hold harmless ArcaSave and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will cease immediately. You may withdraw any remaining funds in accordance with our withdrawal procedures, subject to applicable laws and regulations.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of a recognized arbitration body, except where prohibited by law.
